Government can challenge the President Arif Alvi move

President Arif Alvi ordered to hold elections in Punjab and Khyber Pakhtunkhwa on April 9. By using the constitutional and legal right under section 57 (1) of the Election Act 2017. And the Election Commission under section (2) 57 directed to release the program of the elections. After which the questions have started to arise. Whether the President has the authority to give the date of the general elections of the Provincial Assemblies. And how the government can counter this initiative of the President. And what will be the future of this decision of the President in the coming days.

In this regard, according to the report, President Arif Alvi has the authority to give the date of general elections under section 57 (1) of the Election Act 2017.

According to Section 57(1) of the Election Act 2017, under the Constitution, the President will give the date of the general elections in consultation with the Election Commission and under Section 57(2). The Election Commission will issue the election program in the light of the date given by the President.

However, under the constitution, it is also necessary that when the president gives the date of the elections, a caretaker government should established in place of the elected government in the federation. In the coming days, the Election Commission or the federal government can challenge the President’s move in the Supreme Court.
