Does Nawaz Sharif qualified to contest the election? Despite being acquitted in all the references filed by the Supreme Court in the Panama Papers case, is former Prime Minister Nawaz Sharif eligible to participate in the upcoming general elections?

Constitutional experts have expressed conflicting opinions on the Supreme Court’s decision to disqualify Nawaz Sharif for life. Most of the constitutional experts say that there is no mention of life-long disqualification in Article 62-1F of the Constitution. While according to the interpretation of the Supreme Court, the period of disqualification under this article is for life. 

Later, by amending the Election Act 2017, the period of disqualification has been increased to five years. 

Does Nawaz Sharif qualified to contest the election?

Mian Nawaz Sharif’s disqualification period has ended after the Parliament decided the disqualification period, but the decision will be taken by the Supreme Court anyway. 

On Monday, the Supreme Court has taken notice of the inconsistency between the court verdict and the amendment of the Election Act on the issue of lifelong disqualification and has issued notices to the Attorney General and all provincial advocate generals. 

The Supreme Court took notice of the issue of lifelong disqualification during the hearing of the “Imam Qaisrani v. Mir Badshah Qaisrani” election excuse case. 

Chief Justice Qazi Faiz Isa referred the issue of determining the period of disqualification for life to the Judges Committee for determination before a larger bench and the case will be heard in January 2024. 

Chairman of the Executive Committee of the Pakistan Bar Council, Hasan Raza Pasha, while speaking, said that it is not known how the Supreme Court decided lifelong disqualification under Article 62 1F, although there is no mention of lifelong disqualification in this article.
