The Lahore High Court accepts the request for the return of the passport of Maryam Nawaz.
A 3-member bench headed by Chief Justice Muhammad Amir Bhatti of Lahore High Court hear the various petitions file for obtaining the passport of Maryam Nawaz.
During the hearing on the application for the return of Maryam Nawaz’s passport. Maryam Nawaz’s lawyer Amjad Parvez and NAB prosecutor appears before the 3-member full bench of the Lahore High Court.
Lawyer Amjad Pervaiz says that he apologizes for not appearing on time on the previous date. Chief Justice Amir Bhatti says that no matter, the court does not has interest in this matter. Maryam Nawaz already file applications for the return of the passport.
Maryam’s lawyer says that in the light of the present application, the old applications becomes ineffective. Therefore allow me to withdraw the first application.
The court directs Amjad Parvez to give arguments on the new application for the return of Maryam Nawaz’s passport.
He argues that Maryam Nawaz gets bail on submission of passport. It has been 4 years but no reference has come from Chaudhry Sugar Mills. If they file this case and Maryam would have defend it.
The situation would have been different, restricting one’s movement is also a matter of fundamental rights. Maryam wants this case file so that she can come to her defense.
They terminate the case without looking at the merits. The Chief Justice inquires whether there is any reference to the era of the Messenger of Allah (peace and blessings of Allah be upon him) from where all the laws come from.
Amjad Pervez says that I also say that Allah gives Iblis an opportunity to give his opinion before the punishment.
The said punishment should not be given without giving an opportunity to be heard. In which case the punishment could have hindered the return of the passport, but that is no longer the case.
The Chief Justice inquires that the court keep the passport for its comfort. Has that comfort ended? Maryam Nawaz’s lawyer Amjad Pervez replies that Maryam Nawaz is waitiing for 4 years, no reference files or investigation is conducted. The Chief Justice asks whether we will amend the conditional part of the bail decision or withdraw this part?
Maryam Nawaz’s lawyer says that the court can modify the bail order of Maryam Nawaz. The Chief Justice inquires what is the federal government’s response to this?
The Deputy Attorney General says that we have no objection to return the passport.
The Chief Justice inquires that an appeal files against Maryam’s bail.
Deputy Attorney General replies that I do not know about this. Chief Justice Mohammad Amir Bhatti says that who will tell him? Or have you only hear 1 phrase to do nothing? If the opponents come, they unite the earth and sky, if they are theirs, they fall on the ground. The NAB prosecutor says that under the NAB Amendment Ordinance, we do not know whether this case is under the jurisdiction of NAB or not. There is no pending investigation against Maryam Nawaz, nor is there any need for Maryam Nawaz’s passport.
Now, it is not known whether this case remains after the new amendment, I am not in a position to make any statement on it now.
The Chief Justice asked him what instructions have you received for the return of the passport, we have no objection to the return of the passport.
The Supreme Court accepted Maryam Nawaz’s request and directed to return her passport. On the other hand, when the decision to return Maryam Nawaz’s passport came, the N League workers celebrated and distributed sweets.
