SC of Pakistan on Saturday 23rd July, 2022, in a petition filed by PML-Q, summoned PA Deputy Speaker Mr. Dost Mazari at 2pm and issued notice to newly elected CM Mr. Hamza Shahbaz .
Pervez Elahi Senior Leader of PML-Q had challenged the ruling of PA deputy speaker, through which he rejected 10 votes of PML-Q MPAs in his favour during the CM Punjab election.
A three-member bench — Chief Justice Umar Ata Bandial (Head), Justice Ijaz Ul Ahsan (Member) and Justice Munib Akhtar (Member) — at SC’s Lahore registry is holding the hearing.
PTI’s attorney Ali Zafar gave the court an update on the assembly processes that happened during the election on Friday at the beginning of today’s hearing. The top court ordered the re-election on July 1.
When questioned by Justice Ijaz Ul Ahsan how many members were in the house at the time of the election, Barrister Zafar said that there were 370 members of the provincial legislature. He asserted, “186 votes for Pervez Elahi while Hamza Shahbaz received 179 votes,” and added that Elahi won the CM election legally.
He claimed that the deputy speaker disregarded the parliamentary party’s duty and disregarded the Supreme Court’s judgement in the Article 63A interpretation case when he rejected 10 votes in his decision.
CJP Bandial then declared that the court would summon Deputy Speaker Dost Mazari and send notices to all other parties.
“The deputy speaker should talk to us in person. The only person who can tell us which passage he was referring to is the deputy speaker “said Justice Bandial.
The court has scheduled a 2pm summons for the deputy speaker.
