The police took Imran Khan to the Supreme Court

On the order of Chief Justice of Pakistan Umar Ata Bandial, Islamabad Police took Imran Khan to the Supreme Court. 

Chief Justice Umar Atta Bandyal had ordered the Islamabad Police to produce Imran Khan at half past four. The police reached the Supreme Court with Imran Khan an hour late.  

The Supreme Court of Pakistan is hearing the petition against the arrest of Chairman PTI Imran Khan.

A 3-member bench headed by Chief Justice of Pakistan Umar Ata Bandial is hearing the application.

Apart from Chief Justice Umar Ata Bandial, Justice Muhammad Ali Mazhar and Justice Athar Minullah are also included in the bench.

Arguments of Imran Khan’s lawyer

At the beginning of the hearing, Imran Khan’s lawyer Hamid Khan gave arguments. He said that Imran Khan had come to the Islamabad High Court for bail before his arrest. Khan was abused and Imran Khan was arrested.

Imran Khan’s lawyer told the court that the application cannot be filed without biometrics. So Imran Khan went to get the biometrics done first.

Would it not have been appropriate for NAB to take permission from the Registrar of the High Court. Why did NAB take the law into its own hands? According to the record, the case that was scheduled was probably someone else. The bail application was filed according to the court order but it was not scheduled. How many people of NAB arrested Imran Khan? When 90 people entered the premises of the court, what was the respect of the court? NAB has insulted the court, no one will consider himself safe in the future court. No one can be arrested by the High Court, Supreme Court or accountability court. How many people arrested Imran Khan?

Lawyer Salman Safdar said that there were 80 to 100 people to arrest Imran Khan.

The Chief Justice of Pakistan said that if 80 to 100 people come to the premises, what will happen to the court?

When a person has surrendered to the court, he cannot be arrested

Justice Athar Minullah said that if such arrests start happening, no one will trust the courts in the future.

Lawyer Shoaib Shaheen said that court staff also subjected to torture.

The Chief Justice of Pakistan said that he will examine the compliance of the NAB warrant, not its legality.

Justice Athar Minullah said that the right to surrender before the court cannot be sabotaged.

Lawyer Salman Safdar said that Imran Khan was on the target of terrorists. His security was also taken away. There is no example of how the Rangers arrested Imran Khan. The investigating officer of NAB not even present at the time of arrest.

Justice Athar Minullah said that NAB has been doing the same actions with different people for many years.

Lawyer Salman Safdar told the court that after the arrest of Imran Khan, it was found that the warrant issued on May 1. The interior secretary told the court that the warrant was not received by Imran Khan.

Justice Athar Minullah said that he expects a good response from the political leadership on his appearance in the court.

The Chief Justice of Pakistan said that what happened after the arrest of Imran Khan should have stopped.

Lawyer Hamid Khan replied that the Supreme Court should order the release of Imran Khan.

Lawyer Shoaib Shaheen replied that Imran Khan should have sent a reply to the notice of NAB. The warrant of NAB is illegal.

Justice Athar Minullah said that the question is not about the illegal warrant. But about the procedure for complying with the warrant.

Imran Khan’s lawyer replied that Imran Khan received only one NAB notice.

Justice Athar Minullah said that Justice Muhammad Ali Mazhar is talking about the implementation of the law. The real issue is the right to access to justice.

Justice Athar Minullah asked whether NAB had taken permission from the Registrar High Court before the arrest.

Prosecutor General NAB Asghar Haider appeared in the Supreme Court who told the court that NAB had complied with the warrant from the Ministry of Interior.

Justice Athar Minullah inquired whether the Ministry of Interior executed the warrant in the court premises.

Then prosecutor General NAB replied that he respects the judiciary a lot.

Justice Athar Minullah said that NAB has not learned its lessons for many years. There are many accusations against NAB including political engineering, NAB has destroyed the country a lot.

NAB lawyer Sardar Muzaffar said that look at the conduct of Imran Khan who has been resisting in the past. NAB was in danger of losing their lives.

The Chief Justice of Pakistan said that according to you, the procedure for complying with the NAB warrant decided by the federal government. Was there any NAB officer present at the time of the arrest?

NAB officials could not answer the court’s question

On this occasion, NAB officials could not answer the question of the court.

Prosecutor General NAB said that I do not know all the facts. I have appointed a while ago, even a private person can execute the warrants.

Justice Athar Minullah said that NAB itself continues to implement its warrants.

The NAB prosecutor replied that according to the IG Islamabad he had complied with the warrant. As per the court order the police had complied with the warrant.

The Chief Justice of Pakistan inquired whether the police was monitoring the proceedings as per the court order.

The Advocate General replied that the Rangers had made the arrest under the police.

The Advocate General said that the Rangers personnel were there for the security of Imran Khan.

The Chief Justice of Pakistan said that NAB has expressed its indifference to the compliance of the warrant.

The Advocate General said that there was no restriction under any law to seek permission from the Registrar.

Justice Athar Minullah asked if the windows and doors broken? Read Sections 47 to 50 of the Penal Code, glasses cannot broken even without the permission of Biometric Branch.

Advocate General Islamabad replied that it was not possible to arrest Imran Khan anywhere else, Imran Khan used to call thousands of people on every appearance.

The Chief Justice of Pakistan said that it has become clear that no permission taken, if the accused surrenders in the court and the arrest made from there. Then the court premises will become an easy place for arrests.

Order to produce Imran Khan in one hour

The Supreme Court ordered to produce Imran Khan within an hour.

The Supreme Court ordered that IG Islamabad produce Imran Khan at 4:30 pm.

Glass breaking was wrongful act: Advocate General

Advocate General said that a wrong action done by breaking the glass, Imran Khan’s bail application not yet filed.

The Chief Justice said that the present government does not expected to do this.

Attorney General of Pakistan said that NAB is an independent institution.

NAB put all the blame on the federal government: Justice Athar

Justice Athar Minullah said that NAB has put all the blame on the federal government.

The Attorney General of Pakistan said that NAB requested to appoint Rangers on May 8, NAB’s request to appoint Rangers was not for the execution of warrants, the accountability court has remanded.

The time has come to set an example for the future: Justice Athar

Justice Athar Minullah said that if the foundation is illegal, then the building cannot stand, the time has come to set an example for the future, the manner in which the arrest made cannot tolerated.

Attorney General’s request for extension till tomorrow rejected

The Chief Justice of Pakistan said that the court is very serious about the matter and at the same time, he rejected the request of the Attorney General for an extension till tomorrow.

The time has come for the rule of law to established: Justice Athar

Justice Athar Minullah said that leave Imran Khan alone, even if he was a common citizen, this move would have been intolerable. With all that is happening, the time has come for the rule of law to established.

Another application filed against Imran’s arrest

On the other hand, another petition has filed in the Supreme Court against the arrest of Chairman Tehreek-e-Insaf Imran Khan.

However in the petition, its requested to order the release of Imran Khan and an investigation into his arrest.

It has requested in the petition that an order given to ensure the safety of Imran Khan.

Petitioner argues that the arrest of the PTI leaders is abuse of power and political vendetta.

It has argued in the petition that the government’s behavior is a violation of fundamental rights and Article 9, 10A of the Constitution.

The petitioner is of the view that the intervention of the Supreme Court is inevitable on this violation of fundamental rights.
